By agreeing to provide survey responses, ideas, feedback, and/or other content ("User Content"), you represent and warrant that you have the lawful right to provide it, and that it is true, accurate, complete, and current information. By displaying, publishing, or otherwise posting any User Content on or through the Branded Site, you grant Branded, a limited, non-exclusive, sub-licensable, worldwide, fully-paid, royalty free license to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content in any and all media now known or hereinafter developed without the requirement to make payment to you or to any third party or the need to seek any third party permission. For more information on User Content, please reference our Terms of Service.
The Information Branded Collects
You may provide to Branded what is generally called "personally identifiable" information when you register. At this time, Branded will ask for your first name, last name, email address, zip code, gender, country, username, and password. Information such as your IP address, and general demographic information such as postal code, marital status, education, relationship status, occupation history, ethnicity/race (where permitted by relevant law), health information, employment related information, and non-personally identifiable information on household members, household income, age, etc may be asked.
Branded will also ask for your consent regarding any family related household which you may provide.
The Way Branded Uses Information
You may provide to Branded what is generally called "personally identifiable" information (PII) when you register - such as your name and e-mail address. In addition, Branded gives you the option to provide us with certain demographic information about yourself and to upload photographs or other personally identifiable information.
Where required by law, we require your prior opt-in consent at the time of collection for the processing of (i) personal information for marketing purposes and (ii) personal, sensitive information sensitive per applicable law. You may also withdraw your consent or object at any time, on legitimate grounds, to the processing of your personal information by contacting Branded Compliance at firstname.lastname@example.org.
California Consumer Privacy Act or (“CCPA”)
Under the California Consumer Privacy Act of 2018 ("the CCPA"), all California consumers have the right to request access to the specific pieces of personal information which we have collected over the course of 12 months. As such, you reserve the right to request additional details about our information practices, such as the categories of personal information we have collected about you along with categories of sources of such collection, the commercial or business use of such personal information, the categories of third parties with whom we share your personal information, and the categories of personal information we have disclosed about you in the preceding 12 months.
In addition, we offer members of Branded the following:

Sharing Your Information
Branded, by nature of its business, connects you with different third parties through their offers and surveys. In the event that you subscribe to or opt-in a third party offer or survey, Branded may provide your information to the third party so that we can facilitate the relationship between you and the third party. Personally identifiable information may be shared with third party organizations for their marketing or promotional use without your consent, except with respect to any specific program or feature for which you will have the ability to opt-out. Branded is not responsible for any information which you provide to Third Parties.

Agreeing to Branded Research Terms and Conditions
Site, User Eligibility & Parental Consent
The Site(s) may be used only by persons who are 18 years of age or older, or minors who are 13 to 17 years of age that have parental or legal guardian consent to participate. Minors under the age of 13, or minors between the ages of 13 to 17 years old that do not have their parent's or guardian's consent cannot participate in the Branded Surveys Program. All eligible Users are only allowed to have one registered account. In the case you are a parent or legal guardian who discovers that your child has provided us with any of the foregoing, you may contact Branded Compliance firstname.lastname@example.org to delete their information.
Right to Cookies
When a User visits surveys.gobranded.com or gobranded.com, Branded may send one or more cookies (a small text file containing a string of alphanumeric characters). Branded uses Session Cookies and Permanent Cookies.This is not limited to the following: (a) remembering your information so that you will not have to re-enter it during your visit or the next time you visit the Site; (b) providing custom, personalized advertisements, content and information; (c) monitoring the effectiveness of our marketing campaigns; and (d) monitoring aggregate usage metrics such as total number of visitors and pages viewed.
When hosting surveys for our survey partners, Branded may capture the information provided through these surveys. Branded does not own this information. As such, any information you elect to provide to Branded is used in accordance with the survey partner’s privacy practices.
In the instance during which you provide Branded with any comments, suggestions, or feedback related to our Services (referred to as “Feedback’), you understand that we may, although not obligated to do so, retain, utilize, disclose or otherwise commercially use your Feedback in connection with any or all of our Services without any compensation or consideration to you.

Right to Erasure (Right to be Forgotten)
The Right to be Forgotten, is the right of the User to request their personal, collected data to be erased by Branded. Upon such request, Branded will cease further dissemination of data and contact third parties to halt processing of the User’s data. Branded also reserves the right to cancel your account and delete all User Content associated with your account at any time, and without notice along with the right to permanently restrict your access to the Site or User account.
You may also opt-out and advise Branded to terminate sending you any marketing communications by e-mail. This can be achieved by clicking on the unsubscribe link within the marketing emails you receive from us. You may also contact Branded Compliance at email@example.com.
Description of Services and Fees
Branded offers (i) Users the ability to complete offers provided by certain third party advertisers in return for compensation provided through Branded, and (ii) incentives to Users for referring other people to the Site (together, the 'Branded Surveys Program'). Offers from the Third Parties are available on the Branded Surveys website.
Third Parties and Third Party Content
The Site may contain links or references to information, content, and services which are provided by third parties. Branded does not monitor or have any control over any Third Party Content. As such, your participation in Third Party programs is governed by separate Third Party Terms of Service and Privacy Policies. Branded will never charge you membership fees, however some Third Parties may require you to make a payment in order to complete their offer.
Use of the Branded Surveys Program
Your use of the Branded Surveys Program is governed by Branded Terms of Service. Upon signing up, you will create a password and will be assigned an account number. You are responsible for maintaining the confidentiality of your password and account, and you are responsible for all activities that occur under your password or account, with or without your knowledge. You may not use another Member's account at any time and may be held liable for losses incurred by Branded Surveys or another party due to someone else using your account or password. Branded Surveys will not be liable for any loss or damage arising from your failure to comply with this section.
User Profile and Password
You have access to your personal information and you may update, correct, or delete your member information and email preferences at any time. You are responsible for maintaining the secrecy of your password and account information. With the exception of certain information identified by Branded from time to time, all information which you post for viewing on the site is made publicly available to all Users of the site.
Dealings with Advertisers and other Users
You understand that you, and not Branded, are entirely responsible for all User Content that you upload, post, e-mail, transmit or otherwise make available through the Site including the accuracy, completeness, usefulness, or legality of your User Content or other contributed content. You agree that you must evaluate, and bear all risks associated with the use of any User Content or other contributed content, including any reliance on the accuracy, completeness, usefulness, or legality of such User Content or other contributed content.
Links and Third Party Websites
Your correspondence or business dealings with, or participation in promotions of, advertisers and other Users found on or through the Site are solely between you and the advertiser or User. Branded is not responsible or liable for any loss or damage of any kind incurred as the result of your interactions on our Site. Our terms and policies do not govern your use of any site other than the Site. For more information, reference Branded Terms of Service.
You agree that any feedback, analysis, suggestions and comments which you provide to Branded (known as "Feedback") will become the property of Branded. As Branded provides access to the Site free of charge, the User assigns to Branded, all right, title and interest, including all intellectual property rights, in and to the feedback. Notwithstanding the foregoing assignment, Branded grants to you a non-exclusive, non-transferable, non-sublicensable, world-wide, perpetual and irrevocable license to use the Feedback for your own personal, non-commercial purposes that do not compete, directly or indirectly, with our use of such Feedback. Reference our Terms of Service for more details.
You are solely responsible for your involvement with other Users of the Site. Branded reserves the right, but has no obligation, to monitor disagreements between you and other Users. Branded disclaims all liability related to any User disagreement.
Branded will generally process User payments within 15 days after the end of the month, assuming they have met the minimum payout of $10 USD and that Branded has inspected the Member's account activity before issuing payout. Branded makes no guarantees regarding the timeliness of payments in the case of interferences, such as those by Third Parties, who provide the payouts. Likewise, you expressly authorize Branded Surveys’ service provider, Dwolla, Inc. to originate credit transfers to your financial institution account.
Limitation of Liability
Under no circumstances, including negligence, shall either Branded, the Branded Surveys Program, or the Site, be liable for any direct, indirect, incidental, punitive, special, consequential or exemplary damages, such as damages for loss of profits, goodwill, use, data or other intangible losses arising out of or in any way connected with your use of or performance of Branded Program and/or the Site, whether based on contract, tort, negligence or strict liability. If you are not pleased with your use of the Branded Surveys Program and/or the Site, you may discontinue using the Branded Surveys Program. For more information, reference Branded Terms of Service.
You will indemnify and hold harmless, Branded from and against any costs, damages, expenses, and liabilities (such as reasonable attorneys' fees) arising out of or related to any User Content, your use of the Services or any Content, your violation of this Agreement, or your violation of any rights from Third Parties.
The Branded logo, the Branded Surveys logos and names, the Site, including the copyrighted content, visual interfaces, interactive features, information, graphics, design, compilation, computer code, products, software, services, and all other elements of the Site are intellectual property of Branded and its licensors. You agree not to display or use the logo or names, or the name of 'Branded Surveys.com' or 'Branded Research Inc.' except as expressly allowed. Reference Branded Terms of Service.
Disclaimer of Warranties
The Branded Surveys Program, the Site and content are provided on an 'as is' and 'as available' basis, and Branded is not responsible for prompt or proper delivery or retention of any user information or communications between Users. Branded cannot guarantee that the Branded Surveys Program will meet your requirements or that the Branded Surveys Program will be uninterrupted, timely, secure, or error-free, nor will the results that may be obtained from use of the Branded Surveys Program will be accurate or reliable. Branded disclaims all warranties of any kind, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Digital Millennium Copyright Act Compliance
If you are a copyright owner or an agent thereof, and believe that any User Content or other contributed Content infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA"). If we receive proper notification of claimed copyright infringement, we will respond expeditiously by removing, or disabling access to, the material that is claimed to be infringing. We will also comply with the appropriate provisions of the DMCA in the event a counter-notification is received. We may, at our discretion, deny access to the Site by, or disable and/or terminate the accounts of, Users who may be infringers. For additional details, please reference our Terms of Service.

In the Event of Merger or Sale
Notwithstanding any term of this Agreement, Branded reserves the right, without notice and its sole discretion, to discontinue the Branded Surveys Program or the Site or any of its Services, and further, does not have any commitment toward any Users, past or present. Branded may at any time, for any reason, with or without notice, discontinue the Branded Surveys Program, the Site, and all Services, for one or all of its Users.
EU-U.S. and Swiss-US Privacy Shield Policies
Branded complies with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States, respectively.
